Terms of Use

These Terms of Use set forth the terms and conditions for providing the services (“Services”) to use product information search site “Daikin Business Portal” (“Website”), and the rights and obligations between Daikin Industries, Ltd. (“Daikin”) and registered users of the Services. You must read and agree to the entire Terms of Use before using the Services.

1. You acknowledge that the data, information, materials and software regarding the products of Daikin downloaded from the Website (hereinafter collectively called the “Data”) are provided only for the Purposes. The Purposes of this Service are (i) for designing, installation and consideration for Daikin products, (ii) for effective explanation for Daikin’s customers, and (iii) for positive consideration to purchase Daikin products. You must not use the Data other than for the Purpose. If the Purpose ceases to exist with you (including, but not limited to, for retirement or job-change), you must notify Daikin of the fact without delay. In such case, you must delete all Data from the devices you use and/or have used and must destroy all Data including, but not limited to, its copies and Data printed out, in an appropriate manner.
2. You acknowledge that all of the Data contained in the Website are copyrighted materials owned or controlled by Daikin.
3. You must not copy, modify, delete, change, reverse-engineer, decompile, upload, transmit, provide or sell all or any part of the Data to third parties, without obtaining the prior written approval from Daikin.
4. You must provide accurate information to Daikin with regard to the registration and the usage of the Services, and must notify Daikin without delay if any information registered is changed.
5. You must be responsible for keeping and maintaining your ID number and password for the Service in an appropriate manner.
6. Daikin will check the accuracy of the Data in good faith, but Daikin makes no warranty of any kind, express or implied with respect to the Services, including but not limited to the accuracy of the Data.
7. Under no circumstances will Daikin be liable for any damages incurred by you arising out of discontinuance, suspension, termination, unavailability, or modification by Daikin of the Services, deletion of the registration, or otherwise in connection with the Services.
8. You acknowledge that the Services through the Website may be suspended or ended without notice. The posted in the Website is subject to change and may be added or deleted without notice.
9. In case of stoppage of the Services, you may not be able to access to the Data related products or not be able to purchase products.
10. Daikin may, without prior notice, temporarily suspend the use of the Services by you or cancel your registration at Daikin’s sole discretion;
    - if Daikin finds your non-compliance with the Terms of Use, or your non-usage of the Service for more than three (3) months, or
    – if the Purpose ceases to exist with you.
11. You acknowledge that the contents of the Terms of Use are subject to change without any prior notice.
12. This Terms of Use is governed by the laws of Japan. All disputes, controversies or differences which may arise between the parties hereto, out of or in relation to or in connection with this Terms of Use shall be finally settled by arbitration in Osaka, Japan, in accordance with the Commercial Arbitration Rules of The Japan Commercial Arbitration Association.

Terms of Use of Software

These Terms of Use of Software set forth the terms and conditions for using the software in Daikin Business Portal (“Software”), and the rights and obligations between Daikin and permitted user of the Software. You must read and agree to the entire Terms of Use of Software before using the Software.

1. You acknowledge that the Software is provided only for the Purposes. The Purposes are (i) designing, installation and consideration for Daikin products, (ii) effective explanation for Daikin’s customers, and (iii) positive consideration to purchase Daikin products. You must not use the Software other than for the Purposes.
2. You acknowledge that all of the Software is copyrighted materials owned or controlled by Daikin.
3. You must not copy, modify, delete, change, reverse-engineer, decompile, upload, transmit, or provide or sell to any third party all or any part of the Software without obtaining the prior written approval from Daikin.
